It's a bastardization of a piece of the song "Rainbow Connection", by Kenny Ascher and Paul Williams and most famously performed by Kermit the Frog on his banjo. Yes, but not as often as some believe. Many scenes seem improvised mainly due to the way they were written and/or acted, but it was confirmed by Jenna Fischer on her blog that a very large portion of the show is scripted. One of the more famous improvised scenes is the Michael/Oscar kiss in the episode "Gay Witch Hunt" (which Steve Carell decided to do while cameras were rolling), and Dwight's question to Toby about the female anatomy in "Sexual Harrassment" (Rainn Wilson added a few more questions for Dwight to ask).

It is never really said.Though many have made the assumption that it is because everyone in the office likes Toby and he doesn't have to try very hard to make them like him, unlike Michael who tries everything to get his employees to like him and it doesn't work. At the end of season 2, Michael also states that he does not like Toby because "every time I try to do something fun or exciting, you make it...not that way." Toby does frequently point out how bad Michael's ideas are, and is the one who enforces the office rules which are often in conflict with Michael's method of operation.Here I feel it is important to note, as commented by Michael in one of the 1st season episodes, that Toby, being an HR rep, actually works for head office, and not Michael, so Toby is actually 'Corporate' and as such is there to keep tabs on the entire office and its various policies like safety, ageism etc, he would have been the one that reported to head office the 'Chris Rock' incident in the tolerance episode, along with taking any other complaints from the other staff, which are mostly about Michael anyway. So yes, a huge part of Toby's job would be to keep Michael in check, and Michael obviously deeply resents this.Also important to note is the fact that David Wallace dislikes his own Human Resources worker, this may correlate somehow to the fact that Michael Scott extremely dislikes his own Human Resources worker, Toby Flenderson. Additionally, when Jim briefly took over for Michael, he found himself disliking Toby because he was too quiet.
